Washington, DC—The Honest Elections Project released the following statement responding to criticism of the Supreme Court opinion in Brnovich v. DNC.
Prior to oral argument, the Biden Administration notified the Supreme Court that it believed the two policies being challenged—the requirement that in-person voters cast ballots at assigned precincts, and another banning organized vote trafficking—were legal under the Voting Rights Act. In upholding those laws, the Court agreed with the Biden Administration’s conclusions.

“Facts matter. And the fact is, the Court upheld election rules so commonplace and routine that even the Biden Administration told the Supreme Court that they did not violate the voting rights act. Progressive activists and politicians are predictably mischaracterizing the Brnovich decision to manufacture outrage and drive calls for federal action to weaken voting safeguards nationwide. Today’s Supreme Court decision is a victory for fair elections and the rule of law, and a reminder that states can—and should—make it easy to vote and hard to cheat.”
